MGR medical university directed to continue affiliation to SVS naturopathy college

CHENNAI: The Madras High Court has directed The Tamil Nadu Dr MGR Medical University to continue the affiliation, which was already granted by it, to SVS Medical College of Yoga and Naturopathy and Research Institute at Bangaram in Kallakurichi and to include the college in the ongoing counselling for Naturopathy.

Justice N Kirubakaran gave the directive while passing orders on a batch of writ petitions from the college, on October 11.

A Division Bench, while passing orders on a writ appeal from the college on March 15 last, had directed the university to include the petitioner college for counselling in respect of Naturopathy.

“In those circumstances and invoking the same reasoning, there should not be any prohibition for the university to continue the affiliation, which was already granted by the university and to include the name of the petitioner institution in the ongoing counselling,” the judge said.

The judge also pointed out that the order of disaffiliation dated November 21, 2016 of the university was a non-speaking one and had been stayed by the High Court on a writ petition. “Therefore, the university is directed to include the petitioner institution for counselling in Homoeopathy for the academic year 2017-18, pending disposal of the petition,” the judge said.

“It is true that in the normal circumstances what the Additional Advocate-General submitted against the grant of the petitioner’s prayers would hold good. However, in the peculiar circumstances of the case, the facts have been taken into consideration and order passed, the judge added.

The peculiar circumstances the judge noted was the tragic incident when three students allegedly committed suicide in a well on the college premises in 2015. This unfortunate incident had been employed again and again against the institution and sought to be throttled, thereby preventing institution from functioning, the judge noted.

It was only due to the unforeseen and unfortunate incident that the college had been closed. But for the said incident, the institution was a running one imparting education. “All of a sudden, there cannot be any deficiency or shortcoming in the infrastructure,” the judge added and gave the directive.
