High Court ordered status quo on land acquisition for Andhra Pradesh project

The High Court on Thursday ordered status quo on a petition which challenged land acquisition by the government without paying compensation.

HYDERABAD: The High Court on Thursday ordered status quo on a petition which challenged land acquisition by the government without paying compensation. The property in contention is a house situated on a 734 square yard land at Epigunta village in T Narasapuram mandal in West Godavari district of Andhra Pradesh. Justice A Rajasheker Reddy passed the interim order on a plea made by K Sujanavalli who sought stay of the  acquisition of her property for constructing Chinthalapudi lift irrigation project, which is part of the Polavaram project.

She denied the authorities’ claim that the award of compensation was honoured and the money paid. Petitioner’s counsel P Sasidhar Reddy pointed out that though his client was entitled to receiving compensation to the subject property, the land acquisition authorities concerned resorted to acquire the said property without paying any compensation in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

However, the authorities were showing the records that the compensation had been paid in 2016. Later, the judge directed the authorities to maintain status quo with regard to the petitioner’s property and directed the respondent authorities to place the records pertaining to compensation before the court.
