The White Florida man who shot Markeis McGlockton outside a Clearwater convenience after he was pushed to the ground was charged with manslaughter on Monday, CNN reports.

Pinellas County Sheriff Bob Gualtieri confirmed that the State prosecutor led a review and determined that Michael Drejka, 47, could be charged for the death of McGlockton.

The decision goes against Gualtieri’s initial claim that Drejka was protected under Florida’s controversial “stand your ground” law.

“Consistent with the decision-making process established under Florida law in this case, the State Attorney conducted his review and decided to charge Drejka with manslaughter,” said Gualtieri.

Bernie McCabe, the Pinellas and Pasco County State Attorney, said he came to his decision after reviewing the case for nine days.

“We interviewed witnesses and looked at all the available surveillance video, and we made our decision to move forward based on all the information available,” McCabe said, per CNN.

Drejka, 47, shot and killed 28-year-old McGlockton, a Black man,  on July 19 after the two got into an altercation at a Circle A Food store parking lot.

Police said that Drejka and McGlockton’s girlfriend, Britany Jacobs, got into a confrontation over her parking in a handicap parking spot.

McGlockton saw the argument that Jacobs was having with Drejka, approached him and pushed him to the ground.

Police said that Drejka pulled out his handgun and shot McGlockton killing him.

“This man killed Markeis in cold blood, without a second thought about the devastating impact his actions would have on our family, but this charge gives us a measure of hope that the truth will win and justice will prevail in the end,” McGlockton’s family said in a statement to CNN.

Drejka was arrested Monday morning, had his bail was set for $100,000 and has a court appearance on Tuesday, per reports.
