LUCKNOW: The high court has directed
Hardoi district magistrate Pulkit Khare to pay Rs 20,000 compensation to a man whose motorcycle was detained for a year without any authority of law.
Ordering for immediate release of the vehicle, the court said that the owner had to face many difficulties on account of the illegal act of the police and the DM.
It has directed Khare to pay the amount within 45 days to the person by demand draft and inform the court.
A bench of Justice Ajai Lamba and Justice Dinesh Kumar Singh passed the order on a writ petition by
Dharmendra Kumar.
Kumar had challenged an order of February 28, 2018, whereby the district magistrate had rejected his application for release of the vehicle on the ground that he had a bad reputation and FIR against him.
The court said the petitioner had claimed the vehicle on the basis of purchase documents and the DM could not say no because he had 'a bad reputation'.
Police had taken away Kumar's brand new motorcycle from the roadside and refused to return it.
