Haiti - FLASH : Daméus asks banks to block the accounts of 36 companies
While according to our information, the public action has not been put in motion against the companies alleged to have been involved in the manipulation of PetroCaribe funds, that no referral of an investigating judge with the indictment to inform the concerned was made, Clamé-Ocman Daméus the Commissioner of the Government beyond the legal requirements and the criminal procedure, exercised the power to send a notice to banks in Haiti on November 12, 2018, asking them to suspend the accounts of 36 commercial companies as a precautionary measure, in the context of two judicial inquiries relating to the PetroCaribe case and the over-invoicing of school kits, to which these companies, according to him participated. A notice which with regard to the Haitian legal procedure, should not be followed of effect...

Text of the NOTICE of the Prosecutor :
"Port-au-Prince, November 12, 2018

To the Directors and Managers of the Public and Commercial Banks of Port-au-Prince

The Public Prosecutor's Office at the Court of First Instance of Port-au-Prince presents its compliments to the Public and Commercial Banks of Port-au-Prince and informs them of the request of the Government Commissioner, Mag. Clamé-Ocman Daméus, their Directors and Managers, of immediately suspend all transactional activities with companies whose names follow, by blocking their accounts and those of their shareholders housed within these institutions, under penality of criminal prosecution. These companies and their shareholders are currently subject to conservatory threats from the public prosecutor's office. They are :

The Public Prosecutor's Office draws the attention of these banking institutions to the fact that this conservatory measure is part of two judicial inquiries opened and monitored by the Public Prosecutor's Office of Port-au-Prince concerning the handling of funds related to the case PetroCaribe and the school kits in which companies and their shareholders participated. It counts on the urgency and the imperious collaboration of the banking community for the application of this provision.

The Public Prosecutor's Office at the Port-au-Prince Court of First Instance takes the opportunity to renew to the Port-au-Prince Public and Commercial Banks the assurance of its highest consideration.
