Circuit bench at Jalpaiguri kicks off with caveats
Jalpaiguri: The first ever matter to be filed at the circuit bench of Calcutta high court in Jalpaiguri was a caveat. The caveat was filed on Monday by advocate Partha Chowdhury on behalf of his client Shipra Chakraborty. A resident of Hakimpara in Jalpaiguri, Chakraborty is already in the possession of a decree in her favour from the Civil Judge (Junior Division) of Jalpaiguri.
She was awarded the decree after she claimed that her brother-in-law Biswajit Chakraborty had taken possession of her house wrongfully.
“On Monday we filed a caveat at the circuit bench so that my client gets to know if her brother-in-law moves an appeal against the lower court’s order. In this way, the opposite party won’y be able to get an ex-parte order in his favour,” Chowdhury said.
Incidentally, the second application to be filed was also a caveat. This was filed by advocate Debarati Bhowmik on behalf of Maynaguri resident Narayan Mondol. The petitioner has a decree on a preemption case from the Jalpaiguri District and Sessions Court and filed the caveat for similar reasons.
“I could file the caveat as the Calcutta high court circuit bench has become operational here. It would not have been possible for me otherwise,” said Chakraborty. Her lawyer said that it was like a dream come true.
On Monday, there was no hearing at the circuit bench. Acting Chief Justice Biswanath Somadder of Calcutta high court interacted with lawyers during the day and asked them to ensure that no working day is wasted.
