BATON ROUGE, La. (AP) - Attorneys are seeking a new trial for a Louisiana man convicted in the beating death of his roommate.

The Advocate reports attorneys for 21-year-old David Bueso wrote Monday that he “was denied a trial before a fair cross-section of the community.”

The request follows a decision in an unrelated case Thursday by the Louisiana Supreme Court. Justices said the East Baton Rouge Parish jury pool has been “improperly constituted” since 2011 because people ages 18 to 25 were excluded.



Bueso was 19 when 22-year-old Jhoel Tercero Brisuela was found dead. Bueso was convicted two months ago.

East Baton Rouge Parish District Attorney Hillar Moore III says his office disagrees that anyone convicted in the parish since 2011 should be granted a new trial based on the jury pool issue.
