Patna: HC seeks reply from chief secretary over construction of prison in Arwal

The Patna high court on Friday sought reply from chief secretary over minimum time required to construct district prison in Arwal district which didn’t has one till now even after it got carved out of Jehanabad almost two decades back.

Patna: The Patna high court on Friday sought reply from the chief secretary over minimum time required to construct district prison in Arwal district which didn’t have one till now even after it got carved out of Jehanabad almost two decades back.
A bench of Justice Jyoti Saran and Justice Anjani Kumar Sharan was hearing a public interest litigation (PIL) filed by Binod Kumar in which he had urged the court for directing concerned authorities for constructing building for district court and prison and sanction of posts in lower judiciary and prison respectively for Arwal district which had yet not been done even after two decades.

Even now, it is the district and sessions judge and additional district and sessions judges of Jehanabad before whom cases of Arwal distrct arrive for hearing.
The bench while hearing the matter rapped the state government that it was not bothered to expedite the construction of the prison even after the condition that it had been almost two decades that the Arwal district got formed.
“We direct the chief secretary to intimate us the minimum possible time to construct jail in Arwal district,” the bench gave directions and put the matter again for hearing on May 8.
The court observed that even if the courts start functioning from Arwal district, under trial prisoners would be required to be transported for around 35 kilometres from Jehanabad to Arwal for production in absence of prison.
During the last hearing on the matter on February 18, the court was apprised through a state government’s counter affidavit that five acre land was acquired for prison construction and measurement of land plot was going on.
The court was also appraised by the state government that construction of district court building and judges’ quarters were going on in Arwal which would be completed by October this year to make Arwal district a session division.
The court during hearing on February 6 had observed that counter affidavit of state government as well as the high court simply refers to creation of post and construction of building but most relevant aspect which is of construction of a jail in the district is nowhere given consideration to in either of the affidavits.
