Legal Huddle For MDC, As Another Gokwe Official Files Urgent Chamber Application To Stop Congress

By Own Correspondent- The MDC elective Congress slated for this weekend is facing another legal challenge after an official from Gokwe filed an urgent chamber application to stop it from going ahead.

Maureen Tawengwa, who was a secretary for Gokwe Sesame under the 2014 structures, on Thursday filed a High Court application through her lawyer, Ashel Mutungura. She is seeking an order to halt the MDC Congress at the 11th hour.

Speaking to a local publication, Mutungura confirmed the development. Said Mutungura:

I can confirm the application has been filed with the High Court in Harare. It is an urgent application to interdict Nelson Chamisa from proceeding with the Congress.

There are several reasons; one being that the structures going to the Congress are illegal. The 2014 structures are still in office and their term expires in October and new structures can only be in place after the old ones are dissolved.

Tavengwa has also argued that the nominations were characterised by fraud and other irregularities and that nonmembers were allowed to participate.

The nonmembers who were nominated include Tendai Biti, Settlement Chikwinya and Jacob Mafume, she argued.

Advocate Thabani Mpofu, who is representing the MDC, said that he is not aware of the latest application.

This latest application follows on the heels of a ruling by High Court Judge, Justice Edith Mushore in early May this year which nullified party president Nelson Chamisa’s election.

The case was brought before the High Court by another Gokwe Sesame official, Elias Mashavira.

Meanwhile, the MDC has vowed to continue with its Congress this weekend.-Newsday
