MP HC stays suspension of Ujjain varsity Sanskrit HoD for predicting BJP’s victory

Indore bench of Madhya Pradesh high court on Tuesday stayed an order by Ujjain’s Vikram University vice-chancellor to suspend a professor for violation of election code of conduct by predicting victory of BJP in Lok Sabha elections and posting it on social media.

INDORE: Indore bench of Madhya Pradesh high court on Tuesday stayed an order by Ujjain’s Vikram University vice-chancellor to suspend a professor for violation of election code of conduct by predicting victory of BJP in Lok Sabha elections and posting it on social media.
Justice Vivek Rusia allowed the urgent hearing of the petition by professor Dr Raju Musalgaonkar before a vacation bench and stayed the university’s May 8th order suspending him.

Dr Raju Musalgaonkar, head of school of studies for Sanskrit in Vikram University, was suspended after he had posted on social media on April 29 that BJP will secure around 300 seats and NDA will cross the figure of 300.
A complaint in this regard was made by state Youth Congress secretary Bablu Khinchi, demanding termination of the professor’s services for uploading posts favouring BJP and violating the model code of conduct for elections.
Musalgaonkar’s counsel Kuldeep Pathak argued that the professor was not a government servant, but employed by the university and that he was not given any charge of elections, thus violation of model code of conduct does not apply on him.
Pathak also claimed that Musalgaonkar was a HoD of Sanskrit in the university and the subject of astrology was an inherent portion of his teaching curriculum. The prediction was given without favouring any political party.
