Gaya DM residence worth Rs 400 crore to be auctioned to clear decree amount of Rs 90,975

GAYA: In compliance of Gaya sub judge Sandeep Singh’s order, the official residence of Gaya district magistrate would be put on auction. The proclamation regarding the auction was pasted at the residence on Thursday evening. The order for the same was passed about five months back, on 3 June, 2019.
The market value of the 12 acre area of the DM’s residence is estimated to be about Rs 400 crore and the amount payable to the aggrieved party, an arms dealer is Rs 90,975 and 71 paise plus 6 per cent simple interest thereon.

The auction proclamation has been passed as per Rule 66 pf the Code of Civil Procedure. The legal dispute which ultimately led to the proclamation for the auction of the DM residence dates back to 1976. That year the then DM raided the arms shop of late Nasim Gorganvi located in the Pir Mansoor area of the town. The licence for the the sale of arms was suspended and late Nasim was arrested. In 1995, the Patna high court ordered the restoration of the arm sale licence. Though the licence was restored, the weapons seized were not returned.
In the meantime, Nasim Gorganvi, the licence holder died and the litigation baton was passed on to his son Wasimuddin, a practising lawyer of the Gaya court.
The court ordered the payment of the price of the seized weapons, Rs 57,310 be paid to the licence holder’s son in two instalments, which, according to the petitioner was inadequate. The affected party again approached the court, which directed the government to pay an additional amount of Rs 90,975.71. Following the non payment of the decree amount, the order proclaiming the auction of the DM’s official residence was passed.

As per the procedure laid down for the auction of property on court order, a public announcement through drum beating is also required. But no such drum beat announcement has so far been made in this connection.
District magistrate Abhishek Singh was not available for the official version. An aide of the DM who received the call said that the DM was busy in connection with an important meet.
Ravi Sharma, the arms magistrate and OSD in the DM’s office said that an appeal against the order of the sub judge along with the amount of compensation payable to the petitioner was under consideration in Patna high court.
