Telangana high court's green signal to Karimnagar Municipal Corporation election

HYDERABAD: Reiterating its stand that even the pre-election work falls under the purview of election process and hence cannot be stalled, a division bench of the Telangana high court on Thursday vacated the stay imposed on the election to the Karimnagar Municipal Corporation (KMC).
The bench of Chief Justice Raghavendra Singh Chauhan and Justice A Abhishek Reddy said this while setting aside the order of a single judge who restrained the authorities from going ahead with the poll process without rectifying the glaring errors that crept in.
The errors occurred on account of the lapses in enumerating the population figures of SC and ST sections.
As these lapses are likely to have a larger impact on the election of the whole corporation, the single judge stayed the election in three wards of the corporation. The authorities were asked to go ahead only if they rectify the errors pointed out by the petitioners.
State counsel Sanjeev Kumar furnished to the bench a copy of the single judge order and said that the objections raised by the petitioners were lawfully answered. Moreover, the single judge himself had said that his order would be subject to the judgement of the division bench order. Since the division bench held a view that the election can go ahead, we should be permitted to hold the election in Karimnagar, he said.
The bench referred to the judgements of the Supreme Court in cases like Ponnuswami, MS Gill and Lakshmi Charan Sen and set aside the single judge order paving the way for the conduct of election for KMC.
