HC stays Gujarat's tweaked law on disturbed areas
AHMEDABAD: The Gujarat high court stayed the state government on Wednesday from issuing a notification implementing amendments to the controversial Disturbed Areas Act, particularly about notifying localities as communally disturbed. The HC sought an explanation from the government and the advocate general after Jamiat Ulema-e-Hind claimed that the October 2020 amendment “is an affront to the constitutional value and right of equality, and the constitutional morality that envisions a multicultural society in India”.
The law aims at protecting members of one community from forced or coerced sale of properties in communally disturbed areas to members of another community and mandates prior permission from the government for any sale.
The court ordered the government not to issue any notification till February 3.
