HYDERABAD: Making it clear that it will not accept the state and its machinery acting as
judge, jury and executioner,
Telangana high court on Wednesday sought answers from the advocates representing the state as to why they are preferring frivolous appeals.
A bench of Chief Justice
Hima Kohli and Justice B Vijaysen Reddy warned that henceforth they will have to pay
penalties for such appeals.
The bench posed a series of questions to state counsel Harender Pershad while hearing an appeal filed by the state in respect of 2,450 square yards of land at
Miyapur.
A single judge earlier directed the authorities to resolve the title dispute the state has with an individual, M Bapi Raju, over this land before a competent civil court. But, the authorities demolished the compound wall built by Bapi Raju without notice to him. There is no finding from any
court that this land belongs to the state.
The bench directed the state to explain its case by March 17.
In another appeal filed by the state, the bench noticed that the state expressed grievance over an order of a single judge. But on a close perusal, the bench found that the single judge only passed a consent order after duly obtaining the consent of the state counsel also.
The bench asked the state as to why it is preferring an appeal over such cases.
