Editor’s note: The following is the Avalon Sheriff’s Station significant incidents report for the week of April 28, 2021 to May 4, 2021. All suspects are presumed innocent until proven guilty in a court of law.
Many people who are arrested do not get prosecuted in the first place and many who are prosecuted do not get convicted.
April 28
• Deputies responded to 1 Cabrillo Mole regarding a female juvenile on the Catalina Express without her parents’ permission. They contacted the juvenile and her father and counseled them regarding family law.
April 29
• Deputies assisted the fire departments on Crescent Avenue regarding an elderly female possibly having a seizure.
The woman was treated at the scene for her medical emergency and transported by ambulance to Catalina Island Medical Center for further treatment.
• Deputies received a disturbance (possible drunk) call at 411 Crescent Ave., El Galleon. Deputies contacted the man who was creating the disturbance and warned him regarding his behavior.
He was cooperative and left the location without incident.
April 30
• Deputies received a loud music disturbance call at Hermit Gulch. They contacted a group of campers and advised them of noise laws. The disturbing parties were cooperative and agreed to keep the noise level down.
• Deputies responded to the 200 block of Bird Park Road regarding a vandalism report call.
The victim stated an unknown suspect had slashed her golf cart tire.
Deputies documented the incident and it is currently being investigated by detectives.
• Deputies received a call for service at the Sand Trap regarding a drunk man at the location. Upon arrival, deputies assisted the fire departments who were treating a man for possible alcohol intoxication. He was transported by ambulance to the Catalina Island Medical Center for further evaluation and treatment.
• Deputies received a disturbance call in the 100 block of Marilla Ave. The caller stated there were suspicious juveniles at the property who did not belong there. During their investigation deputies determined the juveniles were staying at the location with their father who had rented the location from AirBnB.
• Deputies responded to 240 Sumner Ave., Vons, regarding a stolen golf cart. During the investigation deputies discovered the reporting party had driven the wrong golf cart from his vacation rental in Hamilton Cove. The golf cart was not stolen and was recovered from the Vons parking lot by the legal owner.
May 1
• Deputies received a call regarding a petty theft that occurred in the 200 block of Bird Park Road. The victim stated an Xbox gaming system was ordered on line and delivered to the address. The victim never received the item and alleged it was stolen from the front porch. A crime report was written and the incident is currently being investigated by detectives.
• Deputies were contacted at Avalon Station by a citizen who stated a juvenile was driving a rental golf cart. The deputies contacted the juvenile and the adult who was allowing the juvenile to drive the cart. They warned them regarding the California Vehicle Code and escorted the golf cart back to the rental agency.
• Deputies responded to 306 Crescent Ave., Blue Water Grill, regarding a business disturbance; possible drunk patrons. Deputies contacted two adult customers who paid their bill and left the location without incident.
• Deputies received a call for service of a person dead on a vessel at Longpoint. Baywatch was on scene and the deputies initiated a death investigation. It was determined that the patient appeared to have died from natural causes. Deputies took control of the patient and transported him via Sheriff’s Safe Boat to Avalon Harbor.
Once in Avalon Harbor the patient was transported by the Avalon Search and Rescue Team to the Catalina Island Medical Center.
May 2
• Deputies responded to the 300 block of Whittley Avenue regarding a welfare check of a 3-year-old child at the location and a possible domestic violence. During their investigation they determined a domestic violence had occurred and arrested Suspect Jose Gamboa, 29, of Avalon on suspicion of domestic violence. The suspect was transported to Avalon Station where he was booked.
• Deputies respond to Island Express regarding a business disturbance call. Deputies contacted a man and a woman who were creating the disturbance. Both parties left the location and stated they would find another transportation company.
• Deputies assisted Baywatch and Harbor Patrol at Cat Harbor regarding a vessel that was taking on water. While working in a unified command with the above agencies, they were able to remove hundreds of gallons of water and safe the vessel from sinking.
• Deputies were conducting foot patrol on Crescent Avenue. During their patrol they noticed two adults were drinking alcohol in public. They detained them and conducted a drinking in public investigation. Their investigation resulted in a man and woman being cited for Avalon Municipal Code 5-12.02 Drinking in Public.
May 3
• Deputies received a call for service of possible bullying at 420 Avalon Canyon Rd., Skate Park. The deputies contacted several children at the location and spoke to them regarding bullying and good behavior. There was no signs of bullying at the location and the children remained at the location and continued to play.
Sheriff’s Safety Message
Residents, it has been brought to our attention the following concerns from residents of Avalon. Please be aware of the following laws and municipal codes regarding the below violations.
Underage Drinking
Business & Professions Code 25662 states that “(a) Except as provided in Section 25667 or 25668, any person under 21 years of age who possesses any alcoholic beverage on any street or highway or in any public place or in any place open to the public is guilty of a misdemeanor and shall be punished by a fine of two hundred fifty dollars ($250) or the person shall be required to perform not less than 24 hours or more than 32 hours of community service during hours when the person is not employed or is not attending school. A second or subsequent violation shall be punishable as a misdemeanor and the person shall be fined not more than five hundred dollars ($500), or required to perform not less than 36 hours or more than 48 hours of community service during hours when the person is not employed or is not attending school, or a combination of fine and community service as the court deems just.”
Drinking In Public
5-12.02 AMC
No person shall drink any alcoholic beverage or possess an open alcoholic beverage container with intent to consume on any public street or sidewalk, in any public building or in any public recreational area.
