Almost two-hundred businesses have been named and shamed in a government list of firms that failed to pay workers the legal minimum wage, including John Lewis and Pret a Manger.

The Body Shop, convenience store McColls and motorway chain Welcome Break also feature in the list of retailers and employers that broke the law between 2011 and 2018.

The Department for Business (BEIS) said the HMRC figures equated to a shortfall of £2.1million and affected 34,000 workers, with a concerning number of them apprentices.

It said John Lewis plc failed to pay £941,355.67 to 19,392 workers during a 2016 technical breach.

Beauty chain The Body Shop underpaid 959 employees by £34,670.

Pret A Manger, one of the UK’s biggest coffee chains, also failed to pay £9,679 to 33 workers.

Martin McColl, which is supplied by Morrisons, also fell short of £258,047 for 4,366 employees.

Meanwhile Welcome Break, which is typically found in motorway service stations, failed to pay £49,031 to 1,591 workers.

The 191 employers have since been made to pay back what they owed, and were fined an additional £3.2million by the tax authority.

Minimum wage breaches can often occur by accident when workers are paid on or just above the minimum wage rate, and then have deductions from their pay for uniform or accommodation.

The employers named today previously underpaid workers by wrongly deducting pay from their wages, including for uniform and expenses, failing to pay for overtime, and failing to pay apprentices the correct rate.

Employers who underpay their staff must pay back arrears to the worker at the current minimum wage rate.

They also face hefty financial penalties of up to 200% of arrears - capped at £20,000 per worker - which are paid to the government. Since 2015, the rules have returned £100 million to 1 million workers.

The UK’S National Living Wage and National Minimum Wage rates rose in April 2021.

The new rate states over 25s should be paid at least £8.91 an hour, and apprentices, £4.30. You can see a full breakdown of the rates, here.

Every single UK worker is entitled to the National Minimum Wage, no matter their age or profession.

Some employers may choose to pay the Real Living Wage, which is based on how much workers should be paid factoring in inflation, each year.

It’s set up by a non-government-run body, and is therefore not mandatory, although many businesses such as supermarkets are enrolled on it. It argues workers should be paid £10.85 in London and £9.50 outside the M25.

Business Minister Paul Scully said: “Our minimum wage laws are there to ensure a fair day’s work gets a fair day’s pay – it is unacceptable for any company to come up short.

“All employers, including those on this list, need to pay workers properly.”

Chair of the Low Pay Commission Bryan Sanderson said: “These are very difficult times for all workers, particularly those on low pay who are often undertaking critical tasks in a variety of key sectors including care.

“The minimum wage provides a crucial level of support and compliance is essential for the benefit of both the recipients and our society as a whole.”

John Lewis told the Mirror the pay discretion occurred in 2016 during a technical breach.

The chain, which pays salaried staff using pay averaging, said it fell short over a small period and rectified it immediately. The average shop and head office worker affected lost £100 at the time.

A John Lewis Partnership spokesperson said: “This was a technical breach that happened four years ago, has been fixed and which we ourselves made public at the time.

“The issue arose because the Partnership smooths pay so that Partners with variable pay get the same amount each month, helping them to budget.

“Our average minimum hourly pay has never been below the national minimum wage and is currently 15% above it.”

A McColl’s spokesperson said: “As a responsible employer we take this matter, which relates to colleague time and attendance recording processes that were in place from 2015 to 2018, very seriously.

“After becoming aware of the matter in early 2018, we took immediate action to apologise to and reimburse affected colleagues. We also put in place robust measures for recording working time into our stores to ensure it does not happen again.”

Pret A Manger said: “This underpayment refers to a historic case that affected 33 Team Members, and we have since made all the required payments to these Team Members and HMRC.”

It said the underpayments, which date back to 2019 were linked to childcare vouchers, a form of salary sacrifice.

“Government rules dictate that these ‘deductions from pay’ reduce the National Minimum Wage eligible pay and therefore this inadvertently caused remuneration to fall below minimum levels.

“The government has since changed the rules on voluntary salary sacrifice schemes and how they interact with the NMW underpayment list, in recognition of the benefits they can bring to employees.”

A Welcome Break spokesman for said: “In 2018, HRMC informed us, along with many other businesses, that our policy on team member uniforms inadvertently led to a breach of the National Minimum Wage.

"As soon as we were made aware of this oversight, we fully reimbursed and apologised to all affected team members. We never intended to underpay our employees and have strengthened our policies and training to prevent this from happening again.”

The Body Shop has also been approached for comment.
