    UP RERA authorises homebuyers to complete Rohtas Plumeria Homes in Lucknow

    According to UP RERA, the promoterAndes Town Planners Pvt. Ltd. didn’t complete the project and its promoters are presently absconding.

    Close to 900 homebuyers of Rohtas Plumeria Homes, a real estate project in Lucknow, can now hope for resumption of construction on the project, 13 years after the launch as the Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has authorised the homebuyers association to complete the remaining work.
    According to UP RERA, the promoterAndes Town Planners Pvt. Ltd. didn’t complete the project and its promoters are presently absconding.

    RERA had revoked the registration of this project on August 3, 2019 for serious breaches of RERA Act by the promoter and constituted a project advisory and monitoring committee.

    Subsequently, RERA had issued a public notice calling upon the Association of Allottees to submit a viable proposal for completion of the remaining work of the project. The Plumeria Homes Welfare Association submitted its proposal in March, 2021 under which they proposed to undertake the remaining development work in association with a developer to be selected through a transparent tender process.

    “UP RERA is continuously endeavoring to protect the interests of the homebuyers and use the provisions of the RERA Act effectively to facilitate completion of the challenged projects and thereby ensure the delivery of houses to the homebuyers. UP RERA has already acted for rehabilitation of some projects in the NCR region and this is the first project in Lucknow wherein the remaining development work is being sought to be completed through the Association of Allottees under the close monitoring of RERA for realizing the objective of this beneficial legislation,” said Rajive Kumar, Chairman of UP RERA.

    RERA has put certain conditions for faster completion of the project. Some of them include, association to follow a transparent process for selection of the new developer, issue an Expression of Interest for selection of the developer within 30 days from the date of order and developer shall be selected based on the quantum of surplus it can generate from the project which can later on be utilized for completing the remaining development work of other incomplete projects of the promoter under the orders of RERA among others.

    The association is also asked to open a separate bank account for the project and can withdraw from this account only on the basis of certificates by the Chartered Accountant, the Architect, and the Structural Engineer of the project after the same is also certified by the Construction Consultant appointed by RERA.
