Noida: Woman alleges assault by brother-in-law, FIR yet to be lodged

A 32-year-old woman has alleged that despite repeatedly giving complaints about sexual assault by her brother-in-law, Noida police is not ready to lodge an FIR in the case.

NOIDA: A 32-year-old woman has alleged that despite repeatedly giving complaints about sexual assault by her brother-in-law, Noida police is not ready to lodge an FIR in the case.
The victim, who was allegedly assaulted by her brother-in-law in her boutique running in Sector 110 area, has alleged that she was pushed to the ground and assaulted by the accused after which she informed Dial 112.

According to the woman, who has been married since 2007 and has two kids aged 14 and 11, she has an ongoing dispute with her husband for the past two years because of “repeated emotional abuse” she suffered at the hands of her husband.
The woman told TOI that her husband has a courier office in Sector 110 and she too runs a boutique in the same premises.
She alleged that around 9pm on August 30 when she was still in the office, she allegedly called her brother-in-law Paritosh Mishra for help to move a rack in the boutique which was stuck due to a heavy machine.
“I had called my brother-in-law for help and he did come to help me. While removing the rack, he suddenly started touching me inappropriately. He then suddenly pushed to the ground and started to bite my lips and remove my clothes,” she said.

The woman said that she ran to save herself and called the police immediately.
She said that she informed her brother too who arrived for her help.
“The Dial 112 team arrived and saw my condition. I had a swollen lip and a mark on my chest,” she said.
A police officer in the Dial 112 team, who reached the spot told TOI that the woman indeed had marks on her neck and a swollen lip.
“As per the scene of crime and the situation, the woman alleged that she was assaulted by the accused who was not found at the spot. There were finger marks near her neck. Her husband was present at the spot and he later took her aside and they spoke to each other. The woman was asked if she wants any action against the accused and she said that she does want action. The matter was then referred to the Phase II police station,” the officer told TOI on condition of anonymity.
However, the woman alleged that when she was sent to the Sector 110 police chowki, the reaction of the police officers was discouraging and they delayed her medical examination.
“A police officer present in the chowki told the clerk that my complaint should not be taken as I had an ongoing dispute with my husband. My medical was conducted around 12:30 am in the night and it confirmed my injuries,” she said.
The woman’s medical report in possession with TOI reads that she has a “contusion on the front of the chest, below the neck” and an “abrasion on the lower lip.”
The woman alleged that despite repeatedly visiting the Phase II police station at least four times and the office of the women’s cell, no FIR has been lodged in the case still.
She alleged that the police has not called her brother-in-law for questioning even once and shared a report on social media stating that her “medical report is not confirm assault.”
In reply to a mediaperson on his tweet on the case, the Noida police has said that the complaint was investigated by the women’s cell and her medical was conducted.
“The allegations made by the complainant have been found to be untrue. During investigation, it was found that the complainant and her husband have a dispute for the past two years and have been staying separately. Her husband has asked her to vacate his office and the allegations have been made to create unnecessary pressure on him,” said the statement.
When contacted, DCP (women’s safety) Vrinda Shukla said that inquiry was conducted in the case thrice but it was found to be “motivated” due to the ongoing dispute with her husband.
The complainant however rued that her complaint is still not lodged and alleged that her husband has been pressurizing her to take her complaint back.
